Osyriz terms of use

Introduction:

Please read these terms of use carefully. This is a binding contract with Osyriz.

Welcome to Osyriz

Your use of Osyriz is subject to these terms, the paid services term, privacy policy and any terms and policies mentioned in the aforementioned documents. Osyriz offers certain paid services, which are subject to the Osyriz Terms of Sale, Paid Services terms as well as any additional terms or conditions that are disclosed to you in connection with such services. Osyriz allows you to discover and purchase content and connect with viewers with similar interests as well as content creators.

These terms of use apply to viewers whether they have a registered account with Osyriz or viewing the content on Osyriz as an unregistered user. We may revise these Terms of Use from time to time and the most current version will govern our Terms of Use Policy and will always be at https://osyriz.com/terms-of-use. If we make a change to these Terms of Use that, in our sole discretion, is material, we will notify you within https://osyriz.com or by sending an email to the email address associated with your account from support@osyriz.com. By continuing to access or use our Services after those changes become effective, you agree to be bound by the revised Terms of Use.

By clicking the “Sign Up” button and registering as a user, you are entering into a legally binding agreement between the user and Osyriz regarding your use of the different Osyriz services.

 

Privacy

The privacy policy of Osyriz delays what data is collected and how it is used. Privacy is important to Osyriz and this document should be reviewed before registering an account with Osyriz

 

Use of Osyriz:

Osyriz offers a wide range of content for all age groups includes videos, audio (for example music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials whether provided by you, Osyriz or a third-party. It is recommended that viewers of Osyriz be at least 11 years of age however, the viewer must gain peri\mission of an adult or guardian to view general content. If you are the legal guardian of a minor (in your region) wishing to view age appropriate content on Osyriz, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity while on Osyriz.

Content is the responsibility of the person or entity that provides it to the Service. Osyriz is under no obligation to host or serve Content. If you see any Content you believe does not comply with the Terms of Use, report the content to support@osyriz.com.


 

When viewing Osyriz or registering an account with Osyriz on behalf of a company or organization, you represent the following:

  1. You have the authority to represent the company, organization or entity,

  2. Agree to the terms of use on behalf of the company, organization or entity.

If a previous user has been banned from Osyriz, the user is forbidden from using Osyriz again. 

Reservation

Using Osyriz does not give you ownership of or rights to any aspect of the platform, including user names or any other Content posted by others on Osyriz.

 

Accounts

Viewer

The viewer is solely responsible for maintaining the confidentiality of their account, their password and for restricting access to their computer. If the viewer permits others to use their account credentials, they agree to these Terms of Service on behalf of all other persons who use the Services under their account or password, and they are responsible for all activities that occur under their account or password. Please make sure the information the viewer provides to Osyriz upon registration and at all other times is true, accurate, current, and complete to the best of their knowledge.

The viewer must not sell, rent, lease, share, or provide access to their account to anyone else, including without limitation, charging anyone for access to administrative rights on their account.

Viewers are to review the Paid Services Terms before using Osyriz. By registering with Osyriz, they accept the terms and policies associated with the platform.

Below are the details of the Stage 1 & Stage 2 fees the viewer can expect:

These Terms of Use relating to Content Creators are additional terms which apply if you use Osyriz as a Content Creator. All content creators will be charged a 10% withdrawal fee per "Request Withdrawal".  Fees will be applied to platform running costs and ongoing project related expenses.

Content Creator

  1. How to set up your account as a Creator account: 

    • Click on the become a content creator button on the feed page. 

    • The content creator applicant will need to upload a valid form of ID and two photos of you in accordance with the requirements set out by Osyriz.

    • Verify the automatic email and accept the terms.

    • Content creators applicants may also need to submit additional information depending on the country where they live.

    • Osyriz may ask the content creator applicant for additional age or identity verification information at any time. Osyriz may reject your application to set up a Content Creator account for any reason, including the reasons stated UltimateFans.tv

    • The content creators will then be able to start adding Content and viewers will be able to subscribe to their account to become their Fans

  2. Only individuals can be Creators. Every Content Creator is bound personally by the Terms of Service.

  3. The Content is not confidential, and you authorize your viewer to access and view your Content on Osyriz for their own lawful and personal use, and in accordance with any licenses that they grant to their Fans.

  4. Osyriz is not responsible for and does not endorse any aspect of any Content posted by the content creators or any other User of Osyriz. Osyriz does not have any obligation to monitor any Content and have no direct control over what the posted Content may comprise.

  5. You also agree to act as custodian of records for the Content that you upload to Osyriz.


 

Unacceptable Use

By viewing content on Osyriz, the viewer agrees not to violate any laws, intellectual property or third party rights. Most of all, the viewer agrees to use Osyriz for purposes permitted in these terms. The viewer will not:

 

These rules do not create any private right of action on the part of any third party or any reasonable expectation that Osyriz will not contain any content that is prohibited by such rules. Osyriz is not liable for any statements or representations included in User Content. Osyriz does not endorse any User Content, opinion, recommendation, or advice expressed therein, and Osyriz expressly disclaims any and all liability in connection with User Content

As permitted by law, Osyriz takes no responsibility and assumes no liability for any viewer content or for any loss or damage resulting therefrom, nor is Osyriz liable for any mistakes, omissions, pornography, defamation, falsehoods, slander, libel, obscenity, or profanity you may encounter when using Osyriz. The viewer’s use of Osyriz is at your own risk. 

Osyriz reserves the right to remove, screen, or edit any User Content posted or stored on Osyriz at any time and without notice, including where such User Content violates these Terms of Service or applicable law.

 

Purchases and Payments

This section describes the terms that apply to Viewers and Content Creator Transactions.

Please note: If Osyriz suspends a viewer’s account in accordance with our rights under the Terms of Use, then any viewer payments, which would otherwise have fallen due during the period of suspension of the viewer, account will be suspended during the period of the suspension of the viewer account.

 

Third party website/content

Osyriz allows content creators to link a number of different websites and social media profiles. A few are listed below:

  1. Instagram

  2. Twitter

  3. Facebook

Osyriz also allows the content creators to link third-party personal websites to their profile as long as the site does not violate Osyriz terms of use or any other term or policy.

Osyriz does not control or endorse any Third-Party Content and makes no representation of any kind regarding the Third-Party Content, including without limitation regarding its accuracy or completeness. The viewer are responsible for deciding if you want to access or use third-party websites or applications that link from Osyriz

 

Intellectual property rights

Other than User Content, Osyriz and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Other than User Content, no right, title, or interest in or to Osyriz or any content on Osyriz is transferred to you, and we reserve all rights not expressly granted. Any use of Osyriz not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws. If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of Osyriz in breach of the Terms, your right to use or access Osyriz will stop immediately and you must, at our option, return or destroy any copies of the materials you have made.

The viewer must not distribute, reproduce, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Osyriz, except as follows:

- you may store files that are automatically cached by your Web browser for display enhancement purposes; and

- your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials;

Osyriz respects the intellectual property of others and follows the requirements set forth in the Digital Millennium Copyright Act (“DMCA”) and other applicable laws. If you are the copyright owner or agent thereof and believe that content posted on Osyriz infringes upon your copyright, please submit a notice to support@osyriz.com and outline concerns to be investigated by Osyriz.

 

Limitation of liabilities

Osyriz, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors will not be liable to you for any of the following:

  1. Personal injury or property damage resulting from access to and use of Osyriz.

  2. Unauthorized access to or use of the Osyriz servers and any personal or financial information stored in them, including unauthorized access to or changes to viewer and content creators account, submissions, transmissions, or data.

  3. Errors, mistakes, or inaccuracies of content.

  4. Account Content or any conduct by viewers or content creators that violates these Terms.

  5. Interruption or cessation of transmission to or from Osyriz.

  6. Bugs, viruses, Trojan horses, malware, ransomware, or other disabling code that may be transmitted to or through Osyriz by any person or that might infect your computer or affect your access to or use of Osyriz or your hardware or software.

  7. Delays or failures you might experience in starting, conducting, or completing any transmissions to or transactions with Osyriz.

  8. Incompatibility between Osyriz and your other services, hardware, or software.

  9. Loss or damage incurred because of the use of any content posted, emailed, sent, or otherwise made available through Osyriz.

Unless caused by gross negligence or intentional misconduct, by Osyriz, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors will not be liable to you for any direct, indirect, special (including so-called consequential damages), statutory, punitive, or exemplary damages arising out of or relating to your access or your inability to access Osyriz or the content. This exclusion applies regardless of theory of liability and even if you told Osyriz about the possibility of these damages or Osyriz knew or should have known about the possibility of these damages.

If you are dissatisfied with Osyriz or have any other complaint, your exclusive remedy is to stop using Osyriz. The maximum liability of Osyriz and its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors to you for any claim will not exceed the greater of one hundred dollars ($100) or the amount you have paid to Osyriz for the applicable purchase out of which liability arose even if the remedy fails in its essential purpose.

 

Releases

The viewer and/or content creators hereby release Osyriz, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors from all liability arising out of User submissions or the conduct of other Users or third parties, including disputes between you and one or more other Users or third parties.

 

Scope of Disclaimers, Exclusions, and Limitations

The disclaimers, exclusions, and limitations stated herein apply to the greatest extent allowed by law, but no more. Osyriz does not intend to deprive the viewer or content creator of any mandatory protections provided to them by law. Because some jurisdictions may prohibit the disclaimer of some warranties, the exclusion of some damages, or other matters, one or more of the disclaimers, exclusions, or limits will not apply to them.

 

Osyriz reserves the right to amend any of the terms of these Terms of Service by posting the amended terms. Your continued use of Osyriz after the effective date of the revised Terms of Use constitutes your acceptance of the terms.

 

pceedings are voluntarily dismissed or are dismissed as part of settlement of that dispute, neither party will be the prevailing party in those proceedings.

Both parties hereby waive the right to a trial by jury for any dispute arising out of or relating to Osyriz or these Terms. Either party may enforce this waiver up to and including the first day of trial. All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, and, unless the Company agrees otherwise, the arbitrator will not consolidate more than one person’s claims. Both parties acknowledge that each party is waiving the right to participate in a class action.

A party will not file a claim arising out of or relating to Osyriz or these Terms more than one year after the cause of action arose. Any claim brought after one year is barred.

Miscellaneous

These Terms constitute the entire agreement between the viewer and/or content creator and Osyriz about your access to Osyriz. It supersedes all earlier or contemporaneous agreements between the viewer or content creator and Osyriz about access to Osyriz. A printed version of this agreement will be admissible in any proceedings arising out of (or relating to) these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and kept in printed form. Any additional terms on Osyriz will govern the items to which they pertain.

The parties may waive any provision in these Terms only by a writing signed by the party or parties against whom the waiver is sought to be enforced. No failure or delay in exercising any right or remedy, or in requiring the satisfaction of any condition, under these Terms, and no act, omission, or course of dealing between the parties, operates as a waiver or estoppel of any right, remedy, or condition.

Viewers and/or content creators may send notice to Osyriz by email at support@osyriz.com unless a specific email address is set out for giving notice. Osyriz will consider an email notice received by Osyriz only when its server sends a return message to you acknowledging receipt. Osyriz may change its contact information on one or more occasions by posting the change on Osyriz.com. Please check Osyriz.com for the most current information for sending notice to Osyriz.

You consent to receiving any notice from Osyriz in electronic form either (1) by email to the last known email address the Company has for you, (2) a notification on your account, or (3) by posting the notice on a place on Osyriz chosen for this purpose.

Osyriz is not responsible for any failure to perform if unforeseen circumstances or causes beyond its reasonable control delays or continues to delay its performance, including: Acts of God, including fire, flood, earthquakes, hurricanes, tropical storms, epidemics, pandemics, or other natural disasters; war, riot, arson, embargoes, acts of civil or military authority, or terrorism; fiber cuts; strikes, or shortages in transportation, facilities, fuel, energy, labor, or materials; failure of the telecommunications or information services infrastructure; and hacking, spam, or any failure of a computer, server, network, or software.
